Terms of Service

1. Parties

These terms govern all work performed by Solaisoft (“we”, “us”) for clients (“you”). Solaisoft is the registered business name of Macdara Ó Murchú, a sole trader operating in Perth, Western Australia. ABN: 24 379 197 237.

2. Services

We offer three primary service types:

  • Web-design builds - fixed-scope website design and development. Scope, deliverables, and price are agreed before work begins.
  • Monthly care plan ($120/mo) - ongoing hosting support, minor updates, and maintenance for sites we have built. Billed monthly, no lock-in contract.
  • Consulting - technical advice, audits, and strategy engagements. Scope and pricing agreed in writing before commencement.

3. Quotes and fixed-fee work

All build quotes are fixed-fee unless otherwise stated in writing. The quote covers the scope described in the agreed brief. Work outside that scope (additional pages, features, or significant design revisions) is priced separately and requires your written approval before we proceed.

4. Client content and approvals

You are responsible for supplying content (text, images, branding) on time and in the agreed format. Delays caused by missing content may affect the project timeline. You are responsible for ensuring all content you supply does not infringe third-party rights.

Feedback rounds are specified per project. We will ask for your sign-off at key stages. Approval at each stage is taken as acceptance that the work matches the brief.

5. Ownership and intellectual property

On receipt of final payment, ownership of the delivered website and its custom-written code transfers to you. You own your site.

We retain the right to display the work in our portfolio unless you request otherwise in writing before project completion.

Third-party components, fonts, or libraries incorporated into the build are subject to their own licences, which we will document on request.

6. Care plan

The monthly care plan covers minor updates, security patches, and general maintenance for sites we host and maintain. It does not cover new feature development or significant redesigns, which are quoted separately.

The care plan is month-to-month. You can cancel at any time by emailing hello@solaisoft.com. Cancellation takes effect at the end of the current billing period. You keep the site.

7. Payment

Payment terms are agreed in writing per project. Invoices are due on the date specified. Work may be paused on overdue accounts.

8. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising from or related to the services is limited to the fees you paid us in the three months preceding the claim. We are not liable for indirect, consequential, or incidental losses, including lost revenue, lost data, or business interruption.

Nothing in these terms excludes liability that cannot be excluded under Australian consumer law.

9. Governing law

These terms are governed by the laws of Western Australia, Australia. Any dispute will be subject to the exclusive jurisdiction of the courts of Western Australia.

10. Changes to these terms

We may update these terms from time to time. The current version is always at solaisoft.com/terms. Continued engagement after a change constitutes acceptance.
